Welcome to MoviePlace. These Terms and Conditions ("Terms") are a legally binding agreement between you and MoviePlace ("we," "our," "us") governing your access to and use of our website and mobile app (together, the "Service"). Please read them carefully.

1. Acceptance of Terms

By accessing and using MoviePlace, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, you must immediately discontinue use of this application.

MoviePlace may allow you to post comments, discussion threads, and other content in our community forum ("User Content"). You retain ownership of your User Content, but by posting it you grant MoviePlace a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, distribute, and adapt that content for the purpose of operating, promoting, and improving the Service.

You are solely responsible for your User Content and represent that you have all rights necessary to post it and that it does not violate any law or third party's rights. You agree not to post content that is:

We do not endorse and are not responsible for any User Content. We are under no obligation to monitor the forum, but we reserve the right to review, edit, remove, or refuse any User Content, and to suspend or ban the posting user's account, at our sole discretion and without prior notice.

MoviePlace does NOT own any of the movies, TV shows, images, or other copyrighted content displayed in this application. All movies, TV shows, posters, artwork, logos, trademarks, and related content are the exclusive property of their respective copyright holders, studios, networks, and distributors.

Upon receiving a valid copyright notice, we commit to removing or disabling access to the allegedly infringing content within 24 to 48 hours. We take copyright concerns seriously and will act promptly to address legitimate complaints.

COUNTER-NOTIFICATION: If you believe content you posted was removed in error, you may submit a counter-notice to johntechdevs254@gmail.com identifying the removed content and stating, under penalty of perjury, that you have a good faith belief the removal was a mistake. We may restore the content after a reasonable review period unless the original complainant initiates further action.

MoviePlace provides information about movies and TV shows sourced from third-party APIs. We do not guarantee the accuracy, completeness, or reliability of any content displayed in the app. All movie and TV show data, including images, descriptions, and ratings, are provided for informational purposes only.

You agree to use MoviePlace only for lawful purposes and in a way that does not infringe the rights of others or restrict their use and enjoyment of the app. By using this app, you consent and agree to comply with all terms outlined in this policy.

We do not endorse any advertiser or the products/services they promote. Where a third-party service becomes unavailable, is modified, or discontinued, we are not liable for any resulting disruption to the Service.

11. Disclaimer of Warranties

THE SERVICE AND ALL MATERIALS WITHIN IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, MOVIEPLACE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED. NOTHING IN THIS SECTION EXCLUDES OR LIMITS ANY WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER THE LAWS APPLICABLE TO YOU.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOVIEPLACE, ITS DEVELOPER, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BECAUSE MOVIEPLACE IS OFFERED FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS (USD 50). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without cause, and with or without notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately, and any accrued Rewards, badges, or account data associated with the Service may be forfeited. Sections of these Terms that by their nature should survive termination (including Sections 6, 11, 12, 13, 21, and 22) will remain in effect.

MoviePlace may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

16. Changes to Terms

MoviePlace reserves the right to revise these terms at any time without notice. By using this app, you are agreeing to be bound by the then-current version of these terms and conditions. Your continued use of the app after any changes constitutes acceptance of those changes.

If you do not agree with any modifications to these terms, you must immediately stop using the application.

17. Age Restriction and Parental Guidance

MoviePlace is intended for users aged 17 and above. By using this app, you confirm that you meet this age requirement. The app may display information about movies and TV shows with various content ratings, including mature content. Parents and guardians are advised to supervise minors' use of this application.

18. Availability and Modifications to the Service

We may modify, suspend, or discontinue the Service, or any part of it, at any time and for any reason, without notice or liability. We do not guarantee that the Service will always be available, uninterrupted, timely, or secure, and we are not liable for any unavailability or loss you may incur as a result.

19. Force Majeure

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, acts of government, internet or telecommunications failures, power outages, or outages of third-party services we rely on (such as TMDB, Firebase, Google Play, or Google AdMob).

20. Export Control and Sanctions Compliance

You represent that you are not located in, or a resident or national of, any country subject to a comprehensive trade embargo, and that you are not listed on any government list of prohibited or restricted parties. You agree to comply with all applicable export control and economic sanctions laws in your use of the Service.

21. Dispute Resolution

If a dispute arises out of or relates to these Terms or the Service, we encourage you to first contact us at johntechdevs254@gmail.com so we can try to resolve it informally. If a dispute cannot be resolved informally within a reasonable time, you and MoviePlace agree that, to the extent permitted by the mandatory law applicable to you, any claim will be brought on an individual basis and not as part of any class, collective, or representative action. Nothing in this section limits any right you may have to bring a claim in small claims court or any non-waivable right under the consumer protection laws of your home jurisdiction.

22. Governing Law

These Terms are intended to be used by MoviePlace's global user base and are not limited to any single jurisdiction. To the extent permitted by law, these Terms and any dispute arising from them will be governed by the laws generally applicable to online services of this kind, without regard to conflict-of-law principles, and without submitting exclusively to the courts of any one country. This does not remove or reduce any mandatory statutory rights or protections you are entitled to under the consumer protection or data protection laws of the country in which you reside, which will continue to apply where required by law.

23. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

24. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MoviePlace regarding the Service and supersede any prior agreements or understandings, whether written or oral.

25. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of MoviePlace to be effective.

26. Assignment

You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.

MoviePlace is committed to complying with all applicable laws and regulations, including copyright laws, data protection regulations, and Google Play policies. We do not support, encourage, or facilitate any form of copyright infringement or illegal activity.
